SHIPPING POLICY / PACT ACT
Processing Time: Under normal circumstances, all orders are processed within 1-2 business days. This is not guaranteed. Orders are not shipped or delivered on weekends or holidays. If we are experiencing a high volume of orders, shipments may be delayed by a few days. Please allow additional days in transit for delivery. If there will be a significant delay in shipment of your order, we will contact you via email or telephone. Orders CANNOT be cancelled after they have left our facility and picked up by our regional logistics partners.
Shipment Confirmation & Order Tracking: You will receive a Shipment Confirmation email once your order has shipped containing your tracking number(s). The tracking number will be active within 24 hours.
Lost / Stolen Package: Nexus Smoke is NOT responsible for any lost or stolen packages. After our logistics partners have marked an item as delivered Nexus Smoke will not be held liable.
Return to Sender: Nexus Smoke maintains the exclusive authority to decide on the provision of any reshipping services.
Should a package be sent back to us due to an address issue, such as being incorrect or incomplete, we hold no obligation to offer a refund or dispatch replacement items at our own cost. In instances where the items are returned to our facility, we will process a refund with the postal cost deducted. In the event that a customer requests the package be re-shipped to them at the corrected address, Nexus Smoke holds the authority to charge for the return shipping.
In the event that a package is returned to the sender because the delivery service was unable to secure an adult signature and proof of ID, Nexus Smoke has the policy to subtract a $5 restocking fee from the refund amount. Additionally, we reserve the prerogative to send out a replacement order only once the original package has been returned and inspected by us. We are not required to resend the package at our own expense.
Expired Products: Nexus Smoke does not ship expired products. If an expired product is received - it is due to an error on our fulfillment end. Customers must return the package in its original condition in order to receive a replacement device.
Customs, Duties, and Taxes: Nexus Smoke is not responsible for any customs and taxes applied to your order. All fees imposed during or after shipping are the responsibility of the customer (tariffs, taxes, etc.).
Damages: Nexus Smoke is not liable for any products damaged or lost during shipping. If you received your order damaged, please contact the shipment carrier to file a claim. Please save all packaging materials and damaged goods before filing a claim.
International Shipping Policy: We currently do not ship outside the U.S.

State and Local Excise Tax Compliance
We adhere to all tax laws, ensuring that state and local excise taxes are added to the price of all items where required. The specific tax amount is determined based on the jurisdiction to which the product is shipped.
Rigorous Age Verification (Agechecker.net)
To ensure responsible sales, we require customers to provide their full legal name, permanent address, date of birth, and the last four digits of their Social Security number. This information is verified through AgeChecker.net, a trusted third-party software, against public records to confirm the purchaser's age (minimum 21 years). If there's a mismatch or if a customer prefers not to provide their Social Security number, they must upload a valid, non-expired government-issued I.D. for manual verification. Orders are subject to cancellation if proper identification isn’t provided within the required timeframe.
Adult Signature Requirement for Delivery
In line with federal laws, all orders containing e-cigarette related products are shipped with Adult Signature Confirmation (21+). The recipient must present a valid government-issued photo ID to the delivery personnel to receive their package.

Your age will be verified during checkout using the AgeChecker Verification Software. It's important to use your real, full name for accurate verification.
Restricted Shipping Areas
Due to varying regulations and our network's limitations, we cannot ship to certain areas or states. Your shipping address will be verified at checkout to determine eligibility. Orders to non-deliverable locations will be refunded. Our network is continuously expanding, so please check if your state is eligible before ordering.

Understanding the Role of the FDA in Vaping Oversight The Food and Drug Administration (FDA) plays a crucial role in regulating vaping products in the U.S. Since September 2020, the FDA has been assessing Premarket Tobacco Applications (PMTAs) for these products. The FDA has indicated that flavored vaping products will only be approved if there is substantial evidence to justify their authorization. The effectiveness of the FDA in establishing a de facto standard that limits legal flavored products (apart from tobacco and menthol flavors) could ultimately be determined by federal courts.
Diverse State and Local Vaping Regulations The U.S. sees most of its vaping restrictions implemented at state and local levels. While cities like San Francisco in California have completely banned the sale of vaping products, the majority of restrictions across the U.S. are focused on flavors and online sales. Despite numerous proposed bans in various states, only a handful of actual bans on flavors and online sales have been enacted, often due to strong grassroots opposition.
A Glimpse into State-Specific Vaping Laws
- Arkansas: Direct, in-person transactions only, prohibiting online sales.
- Arizona: Direct, in-person transactions only, prohibiting online sales.
- Georgia: Vaping products sales are limited to face-to-face retail interactions, banning online sales.
- Hawaii: Starting July 1, 2023, sales of vaping products shipped from outside the state will be prohibited, except to licensed retailers.
- Maine: Online sales of vaping products are illegal, except between licensed businesses.
- Massachusetts: Enacted a statewide ban on flavored vaping products in 2019, excluding tobacco flavors.
- New Jersey: Restricts vape flavors to tobacco only, with additional taxation on vaping products but no nicotine-strength limit.
- New York: Flavor ban (excluding tobacco) and a prohibition on online sales.
- Oregon: Online sales restricted, except between licensed businesses.
- Rhode Island: Permanent flavor ban (excluding tobacco) implemented through the Department of Health.
- South Dakota: Ban on shipping tobacco products, including vapes.
- Utah: Online sales limited to transactions between licensed businesses.
- Vermont: Similar restrictions on online sales as Utah.
